About this event

One of the more challenging aspects of plan administration is identifying controlled groups (CG) and affiliated service groups (ASG). And then, once I have identified the CG or ASG, determining what are my options regarding plan design(s) and testing. Finally, what if I fail to identify a CG/ASG, what are my correction options. In this chapter meeting, we will address all of these important issues.

  • How do I determine if I have a CG or ASG?
  • What attribution rules apply?
  • What coverage and nondiscrimination rules apply?
  • May (or must) I aggregate the plans of related employers?
  • If I fail to identify a CG/ASG, how do I correct the failure?

Stephen W. Forbes, J.D., LL.M. (taxation)

Stephen is an ERISA attorney and educator with 37 years of experience practicing and teaching in the retirement plan area. Mr. Forbes received ASPPA’s 2019 Educators Award. Stephen was vice president of SunGard in charge of Relius Education. He teaches seminars, conferences and webcasts on retirement plan compliance, design and correction. He also provides professional consulting. Mr. Forbes has drafted qualified plan, 403(b), 457(b), 409A and IRA documents. He was the author of “The Form 5500 Filing Guide” and the co-author of “The Pension Library.” Mr. Forbes was a Tax Law Specialist at the IRS National Office (Employee Plans Division) where he trained IRS employees, wrote IRS Notices and Revenue Rulings and participated in several Treasury regulations committees.

Doors open at 7:30 am for check-in, breakfast and networking.  Our program will begin at 8:00 am and this program will end at approximately 9:45 am.  The registration fee includes a full breakfast buffet and hosted valet parking.
